The FDA's "jurisdiction" is far from limited to what you might consider
"food" and "drugs." For instance they have now weighed in on the cell-phone
radiation danger bandwagon and are commissioning studies on the question.
Even the clowns in Washington don't mistake cell phones for food or drugs.
