The good news on this front is that the Supreme Court usually doesn't
second guess the trial court on questions of fact. They accept the judge's
rulings on the facts, and consider questions of process, and questions of
what the constitution means and how it applies to the laws that were
enforced. The bad news is that the Supreme Court is likely to send this
case back to the Appeals court which will try to second-guess the trial
court on questions of fact and everything else. That's the court in which
MS has won before, and where they're placing all their hopes.
