If the average person had that much foresight, it wouldn't be an issue to
begin with. Alas, it seems that only a tiny minority of us are going to see
that kind of threat coming. Most people won't worry until someone they know
actually gets arrested, and by then it is too late.

I think that whether or not this threat materializes (at least, in the US)
will be determined by the outcome of the general struggle for freedom.
Retroactive laws governing undesirable e-mail comments would seem to fall
well after the round-up-all-the-guns and stifle-all-dissenting-communication
measures that mark the boundary between a relatively free society and a
police state.
